Article D1442-18 of the French Labour Code

An industrial tribunal member who, during his term of office, becomes an employer while sitting as an employee, or becomes an employee while sitting as an employer, must declare this to the public prosecutor at the court of appeal and to the president of the industrial tribunal. This declaration automatically entails his resignation.

In the absence of such a declaration, the Public Prosecutor at the Court of Appeal will refer the matter to the Social Division of the Court of Appeal which, after inviting the council member in question to provide evidence of his current status, will, if appropriate, order his compulsory resignation.

Le conseiller prud’homme qui, en cours de mandat, devient employeur alors qu’il siégeait en tant que salarié, ou devient salarié alors qu’il siégeait en tant qu’employeur, doit le déclarer au procureur général près la cour d’appel et au président du conseil de prud’hommes. Cette déclaration entraîne sa démission de plein droit.


A défaut d’une telle déclaration, le procureur général près la cour d’appel saisit la chambre sociale de la cour d’appel laquelle, après avoir invité le membre du conseil en cause à justifier de sa qualité actuelle, prononce, s’il y a lieu, sa démission d’office.
