The prison integration and probation service will forward its opinion on the most appropriate measure and on the obligations and prohibitions likely to be imposed to the sentence enforcement judge in good time before the meeting of the sentence enforcement committee at which the person’s situation will be examined, and will provide, where applicable, any information that will enable the judge to assess whether it is materially impossible for the prisoner to be released on full parole.

This materially impossible situation is characterised when the prisoner has no accommodation or no accommodation compatible with the prohibitions on appearance or contact that may be imposed on him on release, including with a third party.

Le service pénitentiaire d’insertion et de probation transmet en temps utile au juge de l’application des peines, avant la réunion de la commission de l’application des peines au cours de laquelle la situation de cette personne est examinée, son avis sur la mesure la plus adaptée et sur les obligations et interdictions susceptibles d’être prononcées et communique, le cas échéant, tout élément permettant d’apprécier l’éventuelle impossibilité matérielle faisant obstacle à l’application de la libération sous contrainte de plein droit.

Cette impossibilité matérielle est caractérisée lorsque la personne détenue ne dispose d’aucun hébergement ou d’aucun hébergement compatible avec les interdictions de paraître ou de contact susceptibles de lui être imposées à sa libération, y compris auprès d’un tiers ou d’un organisme public ou privé. Il en est de même lorsque sont atteintes les capacités d’accueil des structures recevant des personnes placées en semi-liberté ou en placement à l’extérieur situées dans des lieux compatibles avec les modalités de mise en œuvre de la mesure.
