Article D147-33 of the French Code of Criminal Procedure

The public prosecutor checks whether the person is a person convicted of a crime or offence mentioned in article D. 147-31 and against whom socio-judicial supervision has not been ordered.

When this is the case, it checks with the sentence enforcement judge to see if a parole project is being considered.

If no application for conditional release is registered with the registry of the sentence enforcement judge, or if, if such an application is lodged, the public prosecutor intends to oppose it, the public prosecutor examines the convicted person’s file to assess whether it is appropriate to request the pronouncement of judicial supervision before the person concerned is released.

Le procureur de la République vérifie s’il s’agit d’une personne condamnée pour un crime ou un délit mentionné à l’article D. 147-31 et à l’encontre de laquelle un suivi socio-judiciaire n’a pas été prononcé.

Lorsque tel est le cas, il vérifie auprès du juge de l’application des peines si un projet de libération conditionnelle est en cours d’examen.

Si aucune requête tendant à la libération conditionnelle n’est enregistrée au greffe du juge de l’application des peines, ou si, une telle requête étant déposée, le ministère public entend s’y opposer, le procureur de la République examine le dossier du condamné pour apprécier s’il convient de requérir le prononcé d’une surveillance judiciaire avant la libération de l’intéressé.
