Article D147-36 of the French Code of Criminal Procedure

The expert opinion provided for in article 723-31 may not be ordered if the convicted person’s individual file contains an expert report dating back less than two years, ordered where applicable when an application for conditional release was made, and which concludes that the convicted person is dangerous and from which it emerges that there is a risk of reoffending that appears to be proven.

However, in the case of a person convicted of offences committed before 14 December 2005, he or she may request a second opinion before the sentence enforcement court rules on the prosecution’s request. This counter-expertise, which is then automatic, is ordered by the enforcement court, unless it has previously been ordered by the public prosecutor.

L’expertise prévue par l’article 723-31 peut ne pas être ordonnée si figure dans le dossier individuel du condamné une expertise datant de moins de moins de deux ans, ordonnée le cas échéant à l’occasion d’une demande de libération conditionnelle, et qui conclut à la dangerosité du condamné et d’où il ressort qu’il existe un risque de récidive paraissant avéré.

Toutefois, s’il s’agit d’une personne condamnée pour des faits commis avant le 14 décembre 2005, elle peut demander une contre-expertise avant qu’il ne soit statué sur les réquisitions du ministère public par le tribunal de l’application des peines. Cette contre-expertise, qui est alors de droit, est ordonnée par le tribunal de l’application des peines, sauf si elle a été préalablement ordonnée par le procureur de la République.
