Article D147-5 of the French Code of Criminal Procedure

At any time, the public prosecutor may refer the matter to the sentence enforcement judge so that he can order a medical assessment to check whether the sentenced person still meets the criteria set out in article 720-1-1.

He may also ask the court to order the expert opinion required by the penultimate paragraph of article 720-1-1.

Article D147-5

A tout moment, le procureur de la République peut saisir le juge de l’application des peines afin qu’il ordonne une expertise médicale pour vérifier si le condamné remplit toujours les critères prévus à l’article 720-1-1.

Il peut en outre le saisir pour qu’il ordonne l’expertise exigée par l’avant-dernier alinéa de l’article 720-1-1.
