Article D15-1-3 of the French Code of Criminal Procedure

The authorisation referred to in the first paragraph of Article D. 15-1-2 is issued by the Public Prosecutor at the Paris Court of Appeal after approval has been granted, as appropriate, by the Director General of the National Police, the Director General of the National Gendarmerie or the Director General of Customs and Excise.

This authorisation may only be granted on the proposal of the National Director of the Judicial Police to persons deemed suitable to perform the duties of undercover agents following a training course organised by the Interministerial Technical Assistance Service of the National Directorate of the Judicial Police.

This authorisation as well as the authorisation may be withdrawn at any time by the authorities that issued or granted them. Withdrawal of approval renders the authorisation null and void.

L’habilitation visée au premier alinéa de l’article D. 15-1-2 est délivrée par le procureur général près la cour d’appel de Paris après agrément accordé, selon le cas, par le directeur général de la police nationale, le directeur général de la gendarmerie nationale ou le directeur général des douanes et droits indirects.

Cet agrément ne peut être accordé que sur proposition du directeur national de la police judiciaire aux personnes jugées aptes à remplir les missions d’agents infiltrés à l’issue d’un stage de formation organisé par le service interministériel d’assistance technique de la direction nationale de la police judiciaire.

Cette habilitation ainsi que l’agrément peuvent être retirés à tout moment par les autorités les ayant délivrés ou accordés. Le retrait de l’agrément rend caduque l’habilitation.
