Article D2 of the French Code of Criminal Procedure

Within the jurisdiction of each court of appeal, judicial police officers are equal before the law in prerogative and responsibility; they are placed under the supervision of the public prosecutor and under the control of the investigating chamber.

Within the jurisdiction of each court, the court, the public prosecutor and his deputies alone have the authority to direct the activities of the officers and agents of the judicial police, through, where applicable, their hierarchical superiors, subject to the provisions of article D. 15-4.

The public prosecutor and the investigating judge are free to choose the formations to which the territorially competent judicial police officers belong who will be responsible for executing their requisitions or letters rogatory.

The head of the unit coordinates the execution of the judicial police operations carried out in his department and ensures that reports are forwarded to the judicial authorities.

Dans le ressort de chaque cour d’appel, les officiers de police judiciaire sont égaux devant la loi en prérogative et en responsabilité ; ils sont placés sous la surveillance du procureur général et sous le contrôle de la chambre d’instruction.

Dans le ressort de chaque tribunal, le tribunal, le procureur de la République et ses substituts ont seuls qualité pour diriger l’activité des officiers et agents de police judiciaire, par la voie, s’il y a lieu, de leurs supérieurs hiérarchiques, sous réserve des dispositions de l’article D. 15-4.

Le procureur de la République et le juge d’instruction ont le libre choix des formations auxquelles appartiennent les officiers de police judiciaire territorialement compétents qui seront chargés de l’exécution de leurs réquisitions ou commissions rogatoires.

Le chef de la formation coordonne l’exécution des opérations de police judiciaire effectuées dans son service et veille à la transmission des procès-verbaux aux autorités judiciaires.
