Article D214-227-1 of the French Monetary and Financial Code

The instrument of acceptance provided for in the fourth paragraph of 3° of V of Article L. 214-169 shall include the following information:

1° The title “instrument of acceptance of the assignment or pledge of a business claim”;

2° A reference to the fact that the instrument of acceptance is issued pursuant to the fourth paragraph of 3° of V of Article L. 214-169 and that it has the effects provided for in Article L. 313-29, or, where applicable, Article L. 313-29-1; 3° A description of the assignment or pledge of a business claim. 214-169 and that it has the effects provided for in Article L. 313-29 or, where applicable, Article L. 313-29-1;

3° The designation of the assignee or beneficiary and that of the assignor or debtor.

The acceptance document may be drawn up, signed, stored and sent in electronic form.

L’acte d’acceptation prévu au quatrième alinéa du 3° du V de l’article L. 214-169 comporte les énonciations suivantes :


1° La dénomination “ acte d’acceptation de la cession ou du nantissement d’une créance professionnelle ” ;


2° La mention du fait que l’acte d’acceptation est émis en application du quatrième alinéa du 3° du V de l’article L. 214-169 et qu’elle emporte les effets prévus à l’article L. 313-29, ou, le cas échéant, à l’article L. 313-29-1 ;


3° La désignation du cessionnaire ou du bénéficiaire ainsi que celle du cédant ou du débiteur.


L’acte d’acceptation peut être établi, signé, conservé et transmis sous forme électronique.
