Article D2232-2 of the French Labour Code

The conditions under which the employer seeks the approval of employees in application of articles L. 2232-12, L. 2232-23-1, L. 2232-24 and L. 2232-26 are as follows:

1° The consultation takes place during working hours, by secret ballot in an envelope or by electronic means under the conditions set out in articles R. 2324-5 to R. 2324-17. Its material organisation is the responsibility of the employer;

2° The result of the vote is recorded in minutes, which are made public in the company by any means. These minutes are attached to the approved agreement when it is filed. In the event of an agreement concluded with a mandated elected staff representative or a mandated employee, the minutes are also sent to the mandating organisation.

Les conditions dans lesquelles l’employeur recueille l’approbation des salariés en application des articles L. 2232-12, L. 2232-23-1, L. 2232-24 et L. 2232-26 sont les suivantes :

1° La consultation a lieu pendant le temps de travail, au scrutin secret sous enveloppe ou par voie électronique dans les conditions prévues aux articles R. 2324-5 à R. 2324-17. Son organisation matérielle incombe à l’employeur ;

2° Le résultat du vote fait l’objet d’un procès-verbal dont la publicité est assurée dans l’entreprise par tout moyen. Ce procès-verbal est annexé à l’accord approuvé lors du dépôt de ce dernier. En cas d’accord conclu avec un représentant élu du personnel mandaté ou un salarié mandaté, le procès-verbal est également adressé à l’organisation mandante.
