Article D2315-26 of the French Labour Code

In the absence of an agreement as provided for in Article L. 2315-34, the minutes are drawn up and sent to the employer by the secretary of the Social and Economic Committee within fifteen days of the meeting to which they relate or, if a new meeting is scheduled within this fifteen-day period, before that meeting.

In the context of the consultation provided for in article L. 1233-30, the minutes are drawn up and sent to the employer by the committee secretary within three days of the meeting to which they relate or, if a new meeting is scheduled within this three-day period, before that meeting. If the company is in receivership or liquidation, this period is one day.

In the absence of agreement, the minutes drawn up by the committee secretary contain at least a summary of the committee’s deliberations and the employer’s reasoned decision on the proposals made at the previous meeting.

A défaut d’accord prévu par l’article L. 2315-34, le procès-verbal est établi et transmis à l’employeur par le secrétaire du comité social et économique dans les quinze jours suivant la réunion à laquelle il se rapporte ou, si une nouvelle réunion est prévue dans ce délai de quinze jours, avant cette réunion.

Dans le cadre de la consultation prévue à l’article L. 1233-30, le procès-verbal est établi et transmis à l’employeur par le secrétaire du comité dans un délai de trois jours suivant la réunion à laquelle il se rapporte ou, si une nouvelle réunion est prévue dans ce délai de trois jours, avant cette réunion. Lorsque l’entreprise est en redressement ou en liquidation judiciaire, ce délai est d’un jour.

A défaut d’accord, le procès-verbal établi par le secrétaire du comité contient au moins le résumé des délibérations du comité et la décision motivée de l’employeur sur les propositions faites lors de la précédente réunion.
