In the absence of an agreement as provided for in Article L. 2315-34, the minutes are drawn up and sent to the employer by the secretary of the Social and Economic Committee within fifteen days of the meeting to which they relate or, if a new meeting is scheduled within this fifteen-day period, before that meeting.
In the context of the consultation provided for in article L. 1233-30, the minutes are drawn up and sent to the employer by the committee secretary within three days of the meeting to which they relate or, if a new meeting is scheduled within this three-day period, before that meeting. If the company is in receivership or liquidation, this period is one day.
In the absence of agreement, the minutes drawn up by the committee secretary contain at least a summary of the committee’s deliberations and the employer’s reasoned decision on the proposals made at the previous meeting.
