Article D2315-27 of the French Labour Code

The employer or the staff delegation of the social and economic committee may decide to have meetings of the social and economic committee recorded or stenographed in accordance with article L. 2315-34.

Where this decision is taken by the Social and Economic Committee, the employer may not oppose it, except where the deliberations concern information of a confidential nature within the meaning of article L. 2315-3 and which it presents as such.

Where an external person is called in to record the meetings of the committee, that person is bound by the same obligation of discretion as the members of the social and economic committee.

Unless an agreement between the employer and the elected members of the social and economic committee provides otherwise, the costs of recording and stenography are borne by the employer where the decision to use these means is taken by the employer.

L’employeur ou la délégation du personnel du comité social et économique peuvent décider du recours à l’enregistrement ou à la sténographie des séances du comité social et économique prévu à l’article L. 2315-34.

Lorsque cette décision émane du comité social et économique, l’employeur ne peut s’y opposer sauf lorsque les délibérations portent sur des informations revêtant un caractère confidentiel au sens de l’article L. 2315-3 et qu’il présente comme telles.

Lorsqu’il est fait appel à une personne extérieure pour sténographier les séances du comité, celle-ci est tenue à la même obligation de discrétion que les membres du comité social et économique.

Sauf si un accord entre l’employeur et les membres élus du comité social et économique en dispose autrement, les frais liés à l’enregistrement et à la sténographie sont pris en charge par l’employeur lorsque la décision de recourir à ces moyens émane de ce dernier.
