Article D232-73 of the French Sports Code

The application for a Therapeutic Use Exemption shall be sent to the Agency by the athlete, the person(s) with parental authority or the legal representative of the person concerned, by any means which enables the date of receipt of the application to be established with certainty. It includes:

1° The application form for authorisation drawn up by the Agency in accordance with the model provided by the World Anti-Doping Agency;

2° The signature of the attending physician on the form referred to in 1°, accompanied by a full medical history, including the documentation drawn up by the physician who made the initial diagnosis, where available, and the results of all examinations, laboratory analyses and imaging studies relevant to the application.

For certain pathologies, the list of documents and medical examinations is set by the Agency.

The doctor who signs the authorisation application form, draws up the prescription or carries out the examinations relating to the medical condition cannot be the applicant himself.

The athlete must apply for authorisation for each medical condition.

La demande d’autorisation d’usage à des fins thérapeutiques est adressée à l’agence par le sportif, la ou les personnes investies de l’autorité parentale ou le représentant légal de l’intéressé, par tout moyen permettant d’établir avec certitude la date de la réception de la demande. Elle comporte :

1° Le formulaire de demande d’autorisation arrêté par l’agence d’après le modèle prévu par l’Agence mondiale antidopage ;

2° La signature par le médecin traitant du formulaire mentionné au 1°, accompagné d’un historique médical complet, y compris la documentation établie par le médecin qui a fait le diagnostic initial, lorsque celle-ci est disponible, et les résultats de tous les examens, analyses de laboratoire et études par imagerie pertinents pour la demande.

Pour certaines pathologies, la liste des pièces et examens médicaux est fixée par l’agence.

Le médecin qui signe le formulaire de demande d’autorisation, établit la prescription, ou procède aux examens en rapport avec la pathologie, ne peut être le demandeur lui-même.

Le sportif doit demander une autorisation par pathologie.
