Article D2362-8 of the French Labour Code

In order to allocate the seats of the special negotiating body between the colleges in accordance with Article L. 2362-3 insofar as it refers to the provisions of the third paragraph of Article L. 2352-5, the number of employees to be taken into account is the sum of the number of employees belonging to the colleges of legal entities and assimilated employees of natural persons, subsidiaries and establishments.

A quotient is determined equal to the number of employees calculated in the first paragraph divided by the number of seats allocated to France on the special negotiating body.

Each college is allocated as many seats as the total workforce of each legal entity or natural person, subsidiary or establishment contains times the quotient.

The seat(s) not allocated by application of the provisions of the third paragraph are allocated on the basis of the highest remainder. In the event of a tie, the seat goes to the college representing the largest number of employees.

Pour procéder à la répartition des sièges du groupe spécial de négociation entre les collèges conformément à l’article L. 2362-3 en ce qu’il renvoie aux dispositions du troisième alinéa de l’article L. 2352-5, l’effectif à prendre en compte est la somme des effectifs des salariés appartenant aux collèges des personnes morales et des salariés assimilés des personnes physiques, filiales et établissements.

Il est déterminé un quotient égal à l’effectif calculé au premier alinéa divisé par le nombre de sièges revenant à la France au sein du groupe spécial de négociation.

Il est attribué à chaque collège autant de sièges que le total de ses effectifs de chaque personne morale ou personne physique, filiale ou établissement contient de fois le quotient.

Le ou les sièges non attribués par application des dispositions du troisième alinéa sont attribués au plus fort reste. En cas d’égalité de restes, le siège revient au collège qui représente le plus grand nombre de salariés.
