Article D2621-2 of the French Labour Code

In Guadeloupe, French Guiana, Martinique, Mayotte, La Réunion, Saint-Barthélemy, Saint-Martin and Saint-Pierre-et-Miquelon, the Prefect determines the representativeness of the employers’ and employees’ organisations on the basis of the survey referred to in Article L. 2121-1.
