Article D312-17 of the French Consumer Code

Where the lender does not require immediate repayment of the outstanding capital, it may demand compensation from the defaulting borrower equal to 8% of the unpaid due instalments. However, if the lender agrees to defer future instalments, the amount of compensation is reduced to 4% of the deferred instalments.

Lorsque le prêteur n’exige pas le remboursement immédiat du capital restant dû, il peut demander à l’emprunteur défaillant une indemnité égale à 8 % des échéances échues impayées. Cependant, dans le cas où le prêteur accepte des reports d’échéances à venir, le montant de l’indemnité est ramené à 4 % des échéances reportées.
