Article D3142-4 of the French General Code of Local Authorities

The election is held by post. Ballot papers are sent by registered letter to the prefect.

Each ballot paper is placed in a double envelope; the inner envelope must not bear any mention or distinctive sign; the outer envelope must bear the words “Election of members of the departmental investment harmonisation conference”, the indication of the college to which the person concerned belongs, his or her name, position and signature.

The ballot papers are counted by a committee comprising:

1° The prefect, chairman;

2° A mayor appointed by the chairman of the general council and a mayor appointed by the prefect.

The secretariat of the committee is provided by an official of the prefecture.

A representative of each list may monitor the ballot counting operations.

In the event of a tie, the oldest candidate is declared elected.

The results are published at the behest of the prefect. They may be challenged before the administrative court within ten days of such publication by any elector, by the candidates and by the prefect.

L’élection a lieu par correspondance. Les bulletins de vote sont adressés par lettre recommandée au préfet.

Chaque bulletin est mis sous double enveloppe ; l’enveloppe intérieure ne doit comporter aucune mention ni signe distinctif ; l’enveloppe extérieure doit porter la mention ” Election des membres de la conférence départementale d’harmonisation des investissements “, l’indication du collège auquel appartient l’intéressé, son nom, sa qualité, sa signature.

Les bulletins de vote sont recensés par une commission comprenant :

1° Le préfet, président ;

2° Un maire désigné par le président du conseil général et un maire désigné par le préfet.

Le secrétariat de la commission est assuré par un fonctionnaire de la préfecture.

Un représentant de chaque liste peut contrôler les opérations de dépouillement des bulletins.

En cas d’égalité des suffrages est proclamé élu le candidat le plus âgé.

Les résultats sont publiés à la diligence du préfet. Ils peuvent être contestés devant le tribunal administratif dans les dix jours qui suivent cette publication par tout électeur, par les candidats et par le préfet.
