In the absence of an agreement mentioned in article L 3142-117, the departure on leave may be deferred by the employer under the conditions mentioned in article L. 3142-114, in such a way that the percentage of employees simultaneously absent from the company on leave to create a business, to exercise management responsibilities within a company meeting the criteria of a young innovative company and on sabbatical leave does not exceed 2% of the workforce of this company, until the date on which this condition is met or that the number of days of absence provided for on these leaves does not exceed 2% of the total number of days worked in the twelve months preceding the departure on leave. To allow an employee to take leave, this twelve-month period is extended to a maximum of forty-eight months.
