Article D3142-76 of the French Labour Code

In the absence of an agreement mentioned in article L. 3142-117, under the conditions mentioned in article L. 3142-115, in companies with at least three hundred employees, the start of the period of part-time work may be deferred by the employer if the percentage of employees in the company who simultaneously work part-time under this leave does not exceed 2% of the workforce in this company, until the date on which this percentage condition is met.

A défaut de convention ou d’accord mentionné à l’article L. 3142-117, dans les conditions mentionnées à l’article L. 3142-115, dans les entreprises d’au moins trois cents salariés, le début de la période de travail à temps partiel peut être différé par l’employeur si le pourcentage de salariés de l’entreprise passant simultanément à temps partiel au titre du présent congé ne dépasse pas 2 % de l’effectif de cette entreprise, jusqu’à la date à laquelle cette condition de taux est remplie.
