Article D32-2-2 of the French Code of Criminal Procedure

For the application of the provisions of article 116-1 relating to the audiovisual recording of questioning of persons under criminal investigation, an original recording shall be made and placed under sealed conditions.

A copy of this recording is placed in the file. This copy may be common to all recordings made during the investigation.

On the instruction of the public prosecutor or the public prosecutor, the recordings shall be destroyed by the court registry within the period provided for in the fourth paragraph of Article 116-1.

The technical details of the audiovisual recording are determined by order of the Minister of Justice.

Pour l’application des dispositions de l’article 116-1 relatif à l’enregistrement audiovisuel des interrogatoires des personnes mises en examen en matière criminelle, il est établi un enregistrement original placé sous scellé fermé.

Une copie de cet enregistrement est versée au dossier. Cette copie peut être commune à l’ensemble des enregistrements effectués au cours de l’instruction.

Sur instruction du procureur de la République ou du procureur général, les enregistrements sont détruits par le greffe de la juridiction dans le délai prévu par le quatrième alinéa de l’article 116-1.

Les modalités techniques de l’enregistrement audiovisuel sont déterminées par arrêté du ministre de la justice.
