Article D4021-4-1 of the French Public Health Code

Each National Professional Council and each federative structure adopts its own rules of procedure.

These rules of procedure stipulate, in particular, where this information is not included in the articles of association, the composition and operating procedures of the bodies mentioned in article D. 4021-4, the procedures relating to the budget cycle, the conditions for concluding agreements, the procedures for identifying professionals likely to be appointed as experts and the provisions relating to the management of declarations of interest by the members of the bodies and the experts appointed on behalf of the National Professional Council or the federative structure.

In the case of federative structures, the internal regulations define the terms and conditions under which they fulfil their role of coordinating discussions and work, carrying out functions on behalf of their members and representing them in dealings with the public authorities.

They shall guarantee balanced representation of the different ways in which the profession or speciality is practised.

A person holding the office of president, secretary general or treasurer of a member body of a National Professional Council may not hold one of these offices within the National Professional Council or the federative structure to which the Council has joined.

Article D4021-4-1

Chaque Conseil national professionnel et chaque structure fédérative adopte son règlement intérieur.

Ce règlement intérieur prévoit notamment, dès lors que ces informations ne figurent pas dans les statuts, la composition et les modalités de fonctionnement des instances mentionnées à l’article D. 4021-4, les procédures liées au cycle budgétaire, les conditions de conclusion de conventions, les modalités d’identification des professionnels susceptibles d’être désignés experts ainsi que les dispositions relatives à la gestion des déclarations d’intérêt des membres des instances et des experts désignés au nom du Conseil national professionnel ou de la structure fédérative.

Dans le cadre de structures fédératives, le règlement intérieur définit les modalités selon lesquelles elles remplissent leurs missions de coordination de réflexions et de travaux, de prise en charge de fonctions pour le compte de ses membres et de représentation auprès des pouvoirs publics.

Il garantit la représentation équilibrée des différents modes d’exercice de la profession ou de la spécialité.

Une personne exerçant la fonction de président, secrétaire général ou trésorier d’un organisme membre d’un Conseil national professionnel ne peut pas exercer l’une de ces fonctions au sein du Conseil national professionnel ou de la structure fédérative à laquelle aurait adhéré le conseil.
