Article D44-3 of the French Code of Criminal Procedure

Reporting proposals and ratings provided for in article D. 44-2 are drawn up on a form conforming to the model laid down by the Minister of Justice.

They must include a detailed general assessment, as well as a numerical mark from 0 to 10 and an assessment of each of the following elements when they have been observed:

1. Professional relations with the judicial authority;

2. Quality of coordination of the judicial police activity of the service or unit;

3. Quality of procedures and drafting of reports and minutes;

4. Quality of findings and technical investigations;

5. Value of information given to the public prosecutor;

6. Professional commitment;

7. Ability to conduct investigations;

8. Degree of trust granted.

When one of these elements has not been observed, the notation: “judicial activity not observed” is substituted for the corresponding numerical rating and assessment.

Les propositions de notation et les notations prévues à l’article D. 44-2 sont établies sur un imprimé conforme au modèle fixé par le ministre de la justice.

Elles doivent comporter une appréciation générale circonstanciée, ainsi qu’une note chiffrée de 0 à 10 et une appréciation sur chacun des éléments suivants lorsqu’ils ont été observés :

1. Relations professionnelles avec l’autorité judiciaire ;

2. Qualité de la coordination de l’activité de police judiciaire du service ou de l’unité ;

3. Qualité des procédures et de la rédaction des rapports et des procès-verbaux ;

4. Qualité des constatations et des investigations techniques ;

5. Valeur des informations données au parquet ;

6. Engagement professionnel ;

7. Capacité à conduire les investigations ;

8. Degré de confiance accordé.

Lorsque l’un de ces éléments n’a pas été observé, la mention : ” activité judiciaire non observée ” est substituée à la notation chiffrée et à l’appréciation correspondantes.
