Article D4443-16 of the French Public Health Code

In the event of an election of all the elected members of the Disciplinary Board, in order to allow the renewal by half provided for in the first paragraph of article L. 4443-2, lots are drawn at the first meeting following this election to determine those members whose term of office expires at the end of three or six years respectively.

A member, whether full or alternate, called upon to replace a full member who is absent and unrepresented without valid reason for three consecutive meetings, may, on a proposal from the Disciplinary Board, be declared to have resigned by the governing body. The term of office of elected members of the Disciplinary Board ends when the results of the election to renew their seats are announced.

En cas d’élection ayant porté sur la totalité des membres élus de la chambre de discipline, afin de permettre le renouvellement par moitié prévu au premier alinéa de l’article L. 4443-2, un tirage au sort est effectué lors de la première séance suivant cette élection pour déterminer ceux des membres dont le mandat vient à expiration, respectivement, au terme d’une durée de trois ou six ans.

Un membre, titulaire ou suppléant, appelé à remplacer le membre titulaire, absent et non représenté sans motif valable pendant trois séances consécutives, peut, sur proposition de la chambre de discipline, être déclaré démissionnaire d’office par l’organe de l’ordre. Le mandat des membres de la chambre de discipline élus prend fin à la proclamation des résultats de l’élection destinée à renouveler leur siège.
