Article D45-1-2 of the French Code of Criminal Procedure

At the end of the preparatory criminal meeting, which may be held with the assistance of the clerk of the assize court, the president of the assize court shall draw up or cause to be drawn up a report stating:

-either that no agreement has been reached between the participants;

or
-or the agreement reached on the list of witnesses and experts to be called, their order of deposition and the duration of the hearing, or on some of these three points.

These minutes are signed by the chairman and, where appropriate, by the court clerk, and a copy is given or sent subsequently by any means to the public prosecutor and to all the parties’ lawyers.

The absence of one or more of the lawyers summoned is noted in the minutes. This does not prevent the meeting from being held or an agreement from being reached, unless the chairman considers, in particular in view of the number of lawyers absent, that such an agreement cannot usefully be reached.

The minutes do not mention the absence of one or more lawyers.
No mention is made in the minutes of the content of the exchanges that took place during the meeting.

A l’issue de la réunion criminelle préparatoire, qui peut se tenir avec l’assistance du greffier de la cour d’assises, le président de la cour d’assises établit ou fait établir un procès-verbal faisant état :

-soit de l’absence d’accord intervenu entre les participants ;

-soit de l’accord intervenu portant sur la liste des témoins et des experts qui seront cités, leur ordre de déposition ainsi que la durée de l’audience, ou portant sur certains de ces trois points.

Ce procès-verbal est signé par le président et, le cas échéant, par le greffier, et une copie en est remise ou adressée ultérieurement par tout moyen au ministère public et à l’ensemble des avocats des parties.

L’absence d’un ou plusieurs des avocats convoqués est mentionnée dans le procès-verbal. Elle ne fait pas obstacle à la tenue de la réunion, ni à l’obtention d’un accord, sauf si le président considère, au regard notamment du nombre des avocats absents, qu’un tel accord ne peut être utilement obtenu.

Il n’est pas fait état dans le procès-verbal du contenu des échanges ayant eu lieu au cours de la réunion.
