Article D45-2-1 bis of the French Code of Criminal Procedure

If justified in the interests of the proper administration of justice, the president of the judicial court may decide that a hearing of the correctional court that is held in public pursuant to Article 400 will be broadcast live in several courtrooms of the court.

In the case of a hearing of a criminal court with specialised jurisdiction that extends to the jurisdictions of other judicial courts, he may decide that this hearing will be broadcast live in one or more courtrooms of the judicial court within whose jurisdiction the acts were committed, with the agreement of the president of that court.

The decision to broadcast the hearing shall be brought to the attention of the parties. It shall constitute a measure of judicial administration that may not be appealed.

For the application of the provisions of this article, the courtroom of the court in which the retransmission takes place may be located outside the usual premises of that court, in any place in the town where that court has its seat.

Si l’intérêt de la bonne administration de la justice le justifie, le président du tribunal judiciaire peut décider qu’une audience du tribunal correctionnel qui se déroule publiquement en application de l’article 400 sera retransmise en direct dans plusieurs salles d’audience de la juridiction.

S’il s’agit de l’audience d’un tribunal correctionnel disposant d’une compétence spécialisée qui s’étend aux ressorts d’autres tribunaux judiciaires, il peut décider que cette audience sera retransmise en direct dans une ou plusieurs salles d’audience du tribunal judiciaire dans le ressort duquel les faits ont été commis, avec l’accord du président de cette juridiction.

La décision de retransmission de l’audience est portée à la connaissance des parties. Elle constitue une mesure d’administration judiciaire insusceptible de recours.

Pour l’application des dispositions du présent article, la salle d’audience de la juridiction dans laquelle a lieu la retransmission peut être située hors des locaux habituels de cette juridiction, dans tout lieu de la ville où cette juridiction a son siège.
