Article D45 of the French Code of Criminal Procedure

When the date of the hearing of a case before the Assize Court has been set in accordance with the provisions of Article 238, the president of the assize court shall decide the date for the examination of the accused provided for in Article 272 and that of the criminal preparatory meeting provided for in Article 276-1 with particular regard to the complexity of the case and the number of defendants or civil parties.

It may provide that the preparatory criminal meeting, which the accused does not attend, is held either immediately following his questioning or at a later date. Unless this is not possible, the preparatory meeting must take place at least forty-five days before the date on which the trial is due to open, in order to allow the list of witnesses to be served one month before that date in accordance with Article 281.

Lorsque la date de l’audience d’une affaire devant la cour d’assises a été arrêtée conformément aux dispositions de l’article 238, le président de la cour d’assises décide de la date de l’interrogatoire de l’accusé prévu par l’article 272 et de celle de la réunion préparatoire criminelle prévue par l’article 276-1 au regard notamment de la complexité du dossier et du nombre des accusés ou des parties civiles.


Il peut prévoir que la réunion préparatoire criminelle, à laquelle n’assiste pas l’accusé, se tient, soit immédiatement à la suite de son interrogatoire, soit à une date ultérieure. Sauf impossibilité, la réunion préparatoire doit intervenir au moins quarante-cinq jours avant la date de l’ouverture des débats, afin de permettre la signification de la liste des témoins un mois avant cette date conformément à l’article 281.
