Article D47-1-38 of the French Code of Criminal Procedure

For the purposes of Article 696-112, the national magistrate initially seised of the investigation shall immediately refer the whole of the proceedings to the Deputy European Public Prosecutor as soon as the latter notifies him that he is retaining his referral, except where there are conflicts of jurisdiction as provided for in Articles 696-135 and 696-136. Where the investigation concerns an offence under the Customs Code, the customs authorities are informed of the removal of the investigation.

The decision by the public prosecutor to relinquish jurisdiction or the order made to this end by the investigating judge are measures of judicial administration that may not be appealed.

Article D47-1-38
