Article D47-12-9 of the French Code of Criminal Procedure

Where, pursuant to article 706-106-4, the Public Prosecutor at the Nanterre Judicial Court shall order an investigation into the possible criminal background of a person convicted of offences under Article 706-106-1 or for whom there are one or more plausible reasons for suspecting that he or she has committed or attempted to commit such acts, the investigations are conducted in the form of a preliminary enquiry.

Where, pursuant to the same article, the public prosecutor at the Nanterre judicial court refers the matter to the investigating judge for the same purpose, the proceedings shall be conducted as a preliminary investigation.

Lorsqu’en application de l’article 706-106-4, le procureur de la République près le tribunal judiciaire de Nanterre ordonne une enquête ayant pour objet de retracer l’éventuel parcours criminel d’une personne condamnée pour des faits relevant de l’article 706-106-1 ou pour laquelle il existe une ou plusieurs raisons plausibles de soupçonner qu’elle a commis ou tenté de commettre de tels faits, les investigations se déroulent dans les formes de l’enquête préliminaire.


Lorsqu’en application du même article, le procureur de la République près le tribunal judiciaire de Nanterre saisit aux mêmes fins le juge d’instruction, la procédure se déroule dans les formes de l’instruction.
