Article D47-28 of the French Code of Criminal Procedure

Where a case is referred to the Investigating Chamber pursuant to Article 706-120 when the person under investigation has been involuntarily hospitalised, the president of that court shall request from the director of the host establishment the transmission of a detailed medical certificate, drawn up by one or more psychiatrists of the establishment, indicating whether or not the person’s condition allows him or her to appear in person during all or part of the hearing.

Lorsque la chambre de l’instruction est saisie en application de l’article 706-120 alors que la personne mise en examen a fait l’objet d’une mesure d’hospitalisation d’office, le président de cette juridiction sollicite du directeur de l’établissement d’accueil la transmission d’un certificat médical circonstancié, établi par un ou plusieurs psychiatres de l’établissement, indiquant si l’état de la personne permet ou non sa comparution personnelle pendant l’intégralité ou une partie de l’audience.
