Article D47-29-1 of the French Code of Criminal Procedure

An order for involuntary hospitalisation made pursuant to article 706-135 of this code is immediately enforceable, without prejudice to the possibility of referring the matter to the liberty and custody judge in accordance with the provisions of l’article L. 3211-12 of the Public Health Code in order to terminate the hospitalisation.

On pain of inadmissibility, this order may only be appealed or appealed to the Supreme Court at the same time as an appeal or appeal lodged against the decision declaring the person not criminally irresponsible on the grounds of mental disorder.

An appeal against an order for compulsory hospitalisation does not have suspensive effect.

Where no appeal has been lodged, the order for involuntary hospitalisation lapses if the appeal court finds the person criminally liable and sentences him or her to a custodial sentence. The same applies if, following an appeal in cassation, the referring court finds the person criminally liable and sentences him or her to deprivation of liberty. The order lapses when the custodial sentence is served. The provisions of this paragraph are not, however, exclusive of the application of those of article D. 398, where applicable without interrupting the person’s stay in a healthcare establishment.

L’ordonnance aux fins d’hospitalisation d’office prise en application de l’article 706-135 du présent code est immédiatement exécutoire, sans préjudice de la possibilité de saisine du juge des libertés et de la détention conformément aux dispositions de l’article L. 3211-12 du code de la santé publique afin qu’il soit mis fin à l’hospitalisation.

A peine d’irrecevabilité, cette ordonnance ne peut faire l’objet d’un appel ou d’un pourvoi en cassation qu’en même temps qu’un appel ou qu’un pourvoi formé contre la décision portant déclaration d’irresponsabilité pénale pour cause de trouble mental.

L’appel ou le pourvoi formé contre l’ordonnance aux fins d’hospitalisation d’office n’est pas suspensif.

Lorsqu’elle n’a pas fait l’objet d’un appel, l’ordonnance aux fins d’hospitalisation d’office est caduque si la juridiction d’appel déclare la personne pénalement responsable et la condamne à une peine privative de liberté. Il en est de même si, à la suite d’un pourvoi en cassation, la juridiction de renvoi déclare la personne pénalement responsable et la condamne à une peine privative de liberté. La caducité de l’ordonnance intervient lorsqu’est mise à exécution la peine privative de liberté. Les dispositions du présent alinéa ne sont toutefois pas exclusives de l’application de celles de l’article D. 398, le cas échéant sans interruption du séjour de la personne en établissement de santé.
