The financial penalty and the certificate issued by the competent authority of the issuing State shall be sent, in accordance with the procedures set out in Article D. 48-11, to the Public Prosecutor with territorial jurisdiction, where applicable via the Public Prosecutor.
The public prosecutor with territorial jurisdiction is that of the place where the convicted person’s habitual residence or registered office is located or, failing that, any of that person’s assets or income. However, for fines relating to road traffic offences, the officer of the public prosecutor’s office or the public prosecutor of the place where the automated processing of the recovery of these fines is carried out also has jurisdiction.
If the public prosecutor to whom the financial penalty has been forwarded does not have territorial jurisdiction to act on it, he or she will forward it without delay to the public prosecutor with territorial jurisdiction and will inform the competent authority of the issuing State by any means that leaves a written record.
