Article D514-15 of the French Monetary and Financial Code

After a period of three months from the date of deposit of the pledged item, any depositor may request the sale of the item at the sales periods set by the institution’s internal regulations, even before the term set on the acknowledgement.

The amount of the sale, excluding costs, is paid to the borrowing owner or the holder of the bearer acknowledgement, after deduction of the capital loaned, accrued interest and the amount of ancillary duties due on the day of the sale.

However, new pledged goods may only be sold after expiry of the term stipulated in the loan contract.

Après un délai de trois mois à partir du jour du dépôt de son bien remis en gage, tout déposant peut solliciter, aux périodes de ventes fixées par le règlement intérieur de l’établissement, la vente de ce bien, avant même le terme fixé sur sa reconnaissance.

Le montant de l’adjudication hors frais de cet objet est remis au propriétaire emprunteur ou au détenteur de la reconnaissance au porteur, déduction faite du capital prêté, des intérêts échus et du montant des droits accessoires dus au jour de la vente.

Les marchandises neuves remises en gage ne peuvent néanmoins être vendues qu’après l’expiration du terme stipulé dans le contrat de prêt.
