Article D5213-84 of the French Labour Code

A secondment agreement between the lending adapted undertaking and the user undertaking specifies in particular:

1° The identity and qualifications of the employee concerned;

2° The duration, working hours and location of the secondment;

3° The characteristics of the work to be performed and the working environment;

4° The method for determining the salaries, social security charges and professional expenses that will be invoiced to the user company by the lending adapted company.

Une convention de mise à disposition entre l’entreprise adaptée prêteuse et l’entreprise utilisatrice précise notamment :

3° Les caractéristiques des travaux à accomplir et de l’environnement de travail ;


4° Le mode de détermination des salaires, des charges sociales et des frais professionnels qui seront facturés à l’entreprise utilisatrice par l’entreprise adaptée prêteuse.
