Article D5232-1 of the French Public Health Code

The equipment and services referred to in article L. 5232-3 may only be supplied by service providers and equipment distributors who have competent staff according to the type of equipment or service concerned.

Competent personnel include :

a) On the one hand, the staff working with the person who is ill or has an incapacity or disability in order to provide them with the equipment and services, who have first undergone training, the procedures for which are defined by order of the Minister for Health;

b) On the other hand, staff responsible for guaranteeing the application of professional rules and good practice in the supply of equipment and services, who have previously completed a training course, the details of which are defined by order of the Minister for Health. For the supply of equipment and services belonging to the first three categories defined in article D. 5232-2, these staff are health professionals governed by part four of the public health code.

Article D5232-1

Les matériels et services mentionnés à l’article L. 5232-3 ne peuvent être délivrés que par des prestataires de services et distributeurs de matériels disposant de personnels compétents en fonction du type de matériel ou de service concerné.

Les personnels compétents comprennent :

a) D’une part, les personnels intervenant auprès de la personne malade ou présentant une incapacité ou un handicap afin de lui délivrer les matériels et services, qui ont suivi préalablement une formation dont les modalités sont définies par arrêté du ministre chargé de la santé ;

b) D’autre part, les personnels chargés de garantir l’application des règles professionnelles et de bonne pratique de délivrance des matériels et des services, qui ont suivi préalablement une formation dont les modalités sont définies par arrêté du ministre chargé de la santé. Pour la délivrance de matériel et service appartenant aux trois premières catégories définies à l’article D. 5232-2, ces personnels sont des professionnels de santé régis par la quatrième partie du code de la santé publique.
