Article D5842-3 of the French General Code of Local Authorities

I. – Articles R. 5211-3 to D. 5211-5-2 are applicable in French Polynesia in their wording resulting from Decree no. 2021-258 of 9 March 2021 subject to the adaptations provided for in II to V.

II. – For the application of Article R. 5211-3 :

1° The reference to Article L. 5332-1 is deleted;

2° The references to Articles L. 5214-1, L. 5215-1, and L. 5216-1 are replaced by references to Articles L. 5214-1 and L. 5216-1.

III. – For the application of article R. 5211-4, the words: “by the provisions of articles R. 5212-1, R. 5214-1, R. 5215-2-1, R. 5216-1, R. 5332-1 and R. 5723-1” are replaced by the words: “by an order of the High Commissioner of the Republic in French Polynesia”

III bis.-.For the application of Article D. 5211-4-1, the words: “covered by the provisions of Articles L. 5213-1 and L. 5213-2 of the Labour Code or who may claim the benefit of the provisions of Articles L. 5212-1 to L. 5212-17 of this same code, or who may claim the benefit of Article L. 241-3 of the Code de l’action sociale et des familles” are replaced by the words: “covered by the provisions applicable locally”, and the words: “in Article L. 2123-23” are replaced by the words: “set by order of the High Commissioner of the Republic pursuant to Article L. 2123-23”.

IV. – For the application of article D. 5211-5, the second paragraph is replaced by a paragraph worded as follows: “These travel expenses are paid up to the amount of the daily allowances allocated for this purpose to civil servants in State bodies for the administration of French Polynesia. “

V. – For the application of article D. 5211-5-2, the words: “to D. 2123-22-7” are replaced by the words: “and D. 2123-22-6” and the words: “to urban communities,” are deleted.

Article D5842-3

I. – Les articles R. 5211-3 à D. 5211-5-2 sont applicables en Polynésie française dans leur rédaction issue du décret n° 2021-258 du 9 mars 2021 sous réserve des adaptations prévues du II au V.

II. – Pour l’application de l’article R. 5211-3 :

1° La référence à l’article L. 5332-1 est supprimé ;

2° Les références aux articles L. 5214-1, L. 5215-1, et L. 5216-1 sont remplacées par les références aux articles L. 5214-1 et L. 5216-1.

III. – Pour l’application de l’article R. 5211-4, les mots : ” par les dispositions des articles R. 5212-1, R. 5214-1, R. 5215-2-1, R. 5216-1, R. 5332-1 et R. 5723-1 ” sont remplacés par les mots : ” par un arrêté du haut-commissaire de la République en Polynésie française ”.

III bis.-Pour l’application de l’article D. 5211-4-1, les mots : “ relevant des dispositions des articles L. 5213-1 et L. 5213-2 du code du travail ou pouvant prétendre au bénéfice des dispositions des articles L. 5212-1 à L. 5212-17 de ce même code, ou pouvant prétendre au bénéfice l’article L. 241-3 du code de l’action sociale et des familles ” sont remplacés par les mots : “ relevant des dispositions applicables localement ”, et les mots : “ à l’article L. 2123-23 ” sont remplacés par les mots : “ fixé par arrêté du Haut-commissaire de la République en vertu de l’article L. 2123-23 ”.

IV. – Pour l’application de l’article D. 5211-5, le second alinéa est remplacé par un alinéa ainsi rédigé : ” Ces frais de déplacement sont pris en charge dans la limite du montant des indemnités journalières allouées à cet effet aux fonctionnaires des corps de l’Etat pour l’administration de la Polynésie française. ”

V. – Pour l’application de l’article D. 5211-5-2, les mots : ” à D. 2123-22-7 ” sont remplacés par les mots : ” et D. 2123-22-6 ” et les mots : ” aux communautés urbaines, ” sont supprimés.
