Article D611-5 of the French Commercial code

The groups undertake:

Not to carry out any advertising, except in professional journals and newsletters;

To indicate in their correspondence and on all documents drawn up by them their status as approved prevention groups and the references of the approval decision;

To inform the prefect of any changes to their status and of any changes that have occurred in the persons who direct, manage or administer the groups within a period of one month from the date on which such changes and modifications are made;

To require any person collaborating in their work to observe professional secrecy;

To take out a policy with an approved insurance company or insurer guaranteeing them against the pecuniary consequences of the professional civil liability they may incur as a result of negligence and misconduct committed in the exercise of their activities;

In the event that their approval is withdrawn, to inform their members as soon as they receive notification of the withdrawal decision.

Les groupements s’engagent :

A ne faire aucune publicité, sauf dans les journaux et bulletins professionnels ;

A faire figurer sur leur correspondance et sur tous les documents établis par leurs soins leur qualité de groupements de prévention agréé et les références de la décision d’agrément ;

A informer le préfet des modifications apportées à leur statut et des changements intervenus en ce qui concerne les personnes qui dirigent, gèrent ou administrent les groupements dans le délai d’un mois à compter de la réalisation de ces modifications et changements ;

A exiger de toute personne collaborant à leurs travaux le respect du secret professionnel ;

A souscrire un contrat auprès d’une société d’assurances ou d’un assureur agréé les garantissant contre les conséquences pécuniaires de la responsabilité civile professionnelle qu’ils peuvent encourir en raison des négligences et fautes commises dans l’exercice de leurs activités ;

Au cas où l’agrément leur serait retiré, à en informer leurs adhérents dès réception de la notification de la décision de retrait.
