Article D6113-19 of the French Labour Code

I.-The National Vocational Qualifications Framework comprises eight levels of qualification. It specifies the gradation of skills associated with each of these levels.

II-Level 1 of the National Vocational Qualifications Framework corresponds to mastery of basic skills.

III-The other levels of qualification are defined as follows:

1° Level 2 attests to the ability to carry out simple activities and solve everyday problems using simple rules and tools, by mobilising professional know-how in a structured context. The associated professional activity is carried out with a limited degree of autonomy;

2° Level 3 attests to the ability to carry out activities and solve problems by selecting and applying basic methods, tools, materials and information, in a known context, as well as the ability to adapt the means of execution and one’s behaviour to the circumstances;

3° Level 4 attests to the ability to carry out activities requiring the mobilisation of a wide range of skills, to adapt existing solutions to solve specific problems, to organise one’s work autonomously in contexts that are generally predictable but liable to change, and to participate in the evaluation of activities. The national baccalaureate diploma is classified at this level of the national framework;

4° Level 5 attests to the ability to master know-how in a field of activity, to devise solutions to new problems, to analyse and interpret information, using concepts, and to pass on know-how and methods;

5° Level 6 attests to the ability to analyse and solve unforeseen complex problems in a specific field, to formalise know-how and methods and to capitalise on them. Diplomas conferring the grade of licence are classified at this level of the national framework;

6° Level 7 attests to the ability to devise and implement alternative strategies for the development of professional activity in complex professional contexts, and to assess the risks and consequences of one’s activity. Diplomas conferring the grade of master are classified at this level of the national framework;

7° Level 8 attests to the ability to identify and solve complex and new problems involving a number of fields, using the most advanced knowledge and know-how, and to design and manage research and innovation projects and processes. The national doctoral diploma is classified at this level of the national framework.

IV – The criteria relating to knowledge, know-how and levels of responsibility and autonomy provided for in article D. 6113-18 are set, for the levels of qualification mentioned in III, by joint order of the ministers responsible for health, social affairs, vocational training, national education, higher education, culture, agricultural education, sport and the sea.

I.-Le cadre national des certifications professionnelles comprend huit niveaux de qualification. Il précise la gradation des compétences associées à chacun de ces niveaux.

II.-Le niveau 1 du cadre national des certifications professionnelles correspond à la maîtrise des savoirs de base.

III.-Les autres niveaux de qualification sont définis comme suit :

1° Le niveau 2 atteste la capacité à effectuer des activités simples et résoudre des problèmes courants à l’aide de règles et d’outils simples en mobilisant des savoir-faire professionnels dans un contexte structuré. L’activité professionnelle associée s’exerce avec un niveau restreint d’autonomie ;

2° Le niveau 3 atteste la capacité à effectuer des activités et résoudre des problèmes en sélectionnant et appliquant des méthodes, des outils, des matériels et des informations de base, dans un contexte connu, ainsi que la capacité à adapter les moyens d’exécution et son comportement aux circonstances ;

3° Le niveau 4 atteste la capacité à effectuer des activités nécessitant de mobiliser un éventail large d’aptitudes, d’adapter des solutions existantes pour résoudre des problèmes précis, à organiser son travail de manière autonome dans des contextes généralement prévisibles mais susceptibles de changer, ainsi qu’à participer à l’évaluation des activités. Le diplôme national du baccalauréat est classé à ce niveau du cadre national ;

4° Le niveau 5 atteste la capacité à maitriser des savoir-faire dans un champ d’activité, à élaborer des solutions à des problèmes nouveaux, à analyser et interpréter des informations, en mobilisant des concepts, à transmettre le savoir-faire et des méthodes ;

5° Le niveau 6 atteste la capacité à analyser et résoudre des problèmes complexes imprévus dans un domaine spécifique, à formaliser des savoir-faire et des méthodes et à les capitaliser. Les diplômes conférant le grade de licence sont classés à ce niveau du cadre national ;

6° Le niveau 7 atteste la capacité à élaborer et mettre en œuvre des stratégies alternatives pour le développement de l’activité professionnelle dans des contextes professionnels complexes, ainsi qu’à évaluer les risques et les conséquences de son activité. Les diplômes conférant le grade de master sont classés à ce niveau du cadre national ;

7° Le niveau 8 atteste la capacité à identifier et résoudre des problèmes complexes et nouveaux impliquant une pluralité de domaines, en mobilisant les connaissances et les savoir-faire les plus avancés, à concevoir et piloter des projets et des processus de recherche et d’innovation. Le diplôme national de doctorat est classé à ce niveau du cadre national.

IV.-Les critères relatifs aux savoirs, aux savoir-faire et aux niveaux de responsabilité et d’autonomie prévus à l’article D. 6113-18 sont fixés, pour les niveaux de qualification mentionnés au III, par arrêté conjoint des ministres chargés de la santé, des affaires sociales, de la formation professionnelle, de l’éducation nationale, de l’enseignement supérieur, de la culture, de l’enseignement agricole, des sports et de la mer.
