Article D6152-73-4 of the French Public Health Code

The representative trade union organisations designate the beneficiaries of the overall trade union time credit from among the staff employed by the public bodies mentioned in article 2 of the law of 9 January 1986.

The use of the overall trade union time credit by the beneficiaries is granted by the director of the establishment subject to service requirements. Reasons must be given for any refusal.

At the beginning of each calendar year, the trade union organisations send the Ministry of Health a list of the names of the staff benefiting from the overall trade union time credit and a breakdown of the number of full-time equivalents between these beneficiaries.

On the basis of this information, the Ministry of Health pays each establishment financial compensation.

Les organisations syndicales représentatives désignent les bénéficiaires du crédit global de temps syndical parmi les agents employés par les personnes publiques mentionnées à l’article 2 de la loi du 9 janvier 1986.

L’utilisation du crédit global de temps syndical par les bénéficiaires est accordé par le directeur de l’établissement sous réserve des nécessités de service. Le refus doit être motivé.

Au début de chaque année civile, les organisations syndicales communiquent au ministère chargé de la santé la liste nominative des personnels bénéficiaires du crédit global de temps syndical et la répartition du nombre d’équivalents temps plein entre ces bénéficiaires.

Au vu de ces informations, le ministère chargé de la santé verse à chaque établissement une compensation financière.
