The representative trade union organisations designate the beneficiaries of the overall trade union time credit from among the staff employed by the public bodies mentioned in article 2 of the law of 9 January 1986.
The use of the overall trade union time credit by the beneficiaries is granted by the director of the establishment subject to service requirements. Reasons must be given for any refusal.
At the beginning of each calendar year, the trade union organisations send the Ministry of Health a list of the names of the staff benefiting from the overall trade union time credit and a breakdown of the number of full-time equivalents between these beneficiaries.
On the basis of this information, the Ministry of Health pays each establishment financial compensation.
