I.-To benefit from a professional transition project, the employee must be able to prove :
1° At least twenty-four months’ seniority, consecutive or otherwise, as an employee, including twelve months in the company, whatever the nature of the successive employment contracts;
2° Or at least twenty-four months’ seniority, consecutive or otherwise, as an employee, whatever the nature of the successive contracts, over the last five years, including four months, consecutive or otherwise, on a fixed-term contract over the last twelve months.
These seniority conditions do not apply to an employee who, regardless of the nature of his employment contract and in the twenty-four months preceding his application for a professional transition project, has been absent from work as a result of an occupational illness or an absence from work of at least six months, consecutive or otherwise, as a result of an accident at work, a non-occupational illness or accident.
II -Seniority acquired under :
1° An employment support contract mentioned in article L. 5134-20 ;
2° an apprenticeship contract mentioned in article L. 6221-1 ;
3° A professionalisation contract as referred to in Article L. 6325-1;
4° A contract signed with a young person during their school or university studies;
5° A fixed-term employment contract which is followed by an open-ended contract.
III-This seniority is assessed on the date of departure of the employee for training.
