Article D6431-4 of the French Public Health Code

Members of the Boards of Directors who fall under the incompatibilities or incapacities provided for in article L. 6431-5 are automatically declared to have resigned by the Ministers for Overseas France and Health.

In the event that the aforementioned incompatibilities are applied to the president of the territorial assembly, he or she is replaced by an elected representative, appointed from among its members by the said assembly.

If the aforementioned incompatibilities are applied to the chairman or vice-chairman of the medical commission, the latter shall elect a replacement from among its members.

Les membres des conseils d’administration qui tombent sous le coup des incompatibilités ou incapacités prévues à l’article L. 6431-5 sont déclarés démissionnaires d’office par les ministres chargés de l’outre-mer et de la santé.

Au cas où il est fait application des incompatibilités susvisées au président de l’assemblée territoriale, celui-ci est remplacé par un représentant élu, désigné en son sein par ladite assemblée.

Au cas où il est fait application desdites incompatibilités au président ou au vice-président de la commission médicale, celle-ci élit en son sein un remplaçant.
