Article D7121-42 of the French Labour Code

Undertakings established in another Member State of the European Union or another State party to the Agreement on the European Economic Area which employ seconded employees mentioned in 2° of article D. 7121-29 may be exempted from the obligations set out in this section if they can prove that these employees benefit, for the period of secondment, from their paid holiday entitlements under conditions at least equivalent to those provided for by French legislation.

Les entreprises établies dans un autre Etat membre de l’Union européenne ou d’un autre Etat partie à l’accord sur l’Espace économique européen qui emploient des salariés détachés mentionnés au 2° de l’article D. 7121-29 peuvent s’exonérer des obligations figurant à la présente section lorsqu’elles justifient que ces salariés bénéficient, pour la période de détachement, de leurs droits à congés payés dans des conditions au moins équivalentes à celles prévues par la législation française.
