Research may only be carried out under the following conditions:
– under the direction and supervision of a doctor with appropriate experience ;
– in material and technical conditions appropriate to the research and compatible with the requirements of scientific rigour and the safety of the persons undergoing the research.
In the human behavioural sciences, a qualified person, together with the investigator, may direct the research.
Research in the field of dentistry may only be carried out under the direction and supervision of a dental surgeon or doctor with appropriate experience.
Research involving humans in the field of midwifery and complying with the provisions of the last paragraph of Article L. 1121-5 may only be carried out under the direction and supervision of a doctor or midwife.
The research mentioned in 2° of article L. 1121-1 concerning nursing care may only be carried out under the direction and supervision of a nurse or doctor.
The research mentioned in 2° of article L. 1121-1 and which has no influence on the medical care of the person who undergoes it, as well as non-interventional research, may be carried out under the direction and supervision of a qualified person. The Personal Data Protection Committee ensures that the qualifications of the investigator(s) match the characteristics of the research.
For the research referred to in 1° of Article L. 1121-1, recommendations for good practice are laid down by decision of the Agence nationale de sécurité du médicament et des produits de santé. For the research mentioned in 2° of the same Article L. 1121-1 and non-interventional research, recommendations for good practice are laid down by regulation.
The persons responsible for the quality control of research involving the human person and duly authorised for this purpose by the sponsor have access, subject to the absence of opposition from the duly informed persons concerned, to the individual data strictly necessary for this control; they are subject to professional secrecy under the conditions defined by articles 226-13 and 226-14 of the French Penal Code.
