Article L1128-4 of the French Public Health Code

Legal entities declared criminally liable, under the conditions set out in article 121-2 of the French Penal Code, for the offence defined in article L. 1128-3 shall incur, in addition to the fine set out in article 131-38 of the French Penal Code, the penalties set out in article 131-39 of the same code.

The prohibition mentioned in 2° of article 131-39 of the French Penal Code applies to the activity in the exercise of which or on the occasion of which the offence was committed.

Les personnes morales déclarées responsables pénalement, dans les conditions prévues par l’article 121-2 du code pénal, de l’infraction définie à l’article L. 1128-3 encourent, outre l’amende suivant les modalités prévues par l’article 131-38 du code pénal , les peines prévues par l’article 131-39 du même code.

L’interdiction mentionnée au 2° de l’article 131-39 du code pénal porte sur l’activité dans l’exercice de laquelle ou à l’occasion de laquelle l’infraction a été commise.
