Article L1143-6 of the French Public Health Code

The court hearing the action referred to in article L. 1143-2 may, with the agreement of the parties, instruct a mediator, under the conditions set out in section 1 of chapter I of title II of law no. 95-125 of 8 February 1995 relating to the organisation of the courts and to civil, criminal and administrative procedure, to propose to the parties an agreement setting out the terms of amicable compensation for the damages which are the subject of the action.

The court sets the duration of the mediator’s assignment, which may not exceed three months. It may extend it once, within the same limit, at the mediator’s request.

Le juge saisi de l’action mentionnée à l’article L. 1143-2 peut, avec l’accord des parties, donner mission à un médiateur, dans les conditions fixées à la section 1 du chapitre Ier du titre II de la loi n° 95-125 du 8 février 1995 relative à l’organisation des juridictions et à la procédure civile, pénale et administrative, de proposer aux parties une convention réglant les conditions de l’indemnisation amiable des dommages qui font l’objet de l’action.

Le juge fixe la durée de la mission du médiateur dans la limite de trois mois. Il peut la prolonger une fois, dans la même limite, à la demande du médiateur.
