Article L1161-1 of the French Public Health Code

Therapeutic education is part of a patient’s care programme. Its aim is to make patients more independent by facilitating their compliance with prescribed treatments and improving their quality of life. It is not enforceable against the patient and cannot affect the rate of reimbursement for procedures and medicines relating to the patient’s illness.

The skills required to provide therapeutic patient education are determined by decree.

Within the framework of the programmes or actions defined in article L. 1161-3, any direct contact between a patient and their family and a company involved in the exploitation of a medicinal product or a person responsible for marketing a medical device or its accessory or an in vitro diagnostic medical device or its accessory is prohibited.

L’éducation thérapeutique s’inscrit dans le parcours de soins du patient. Elle a pour objectif de rendre le patient plus autonome en facilitant son adhésion aux traitements prescrits et en améliorant sa qualité de vie. Elle n’est pas opposable au malade et ne peut conditionner le taux de remboursement de ses actes et des médicaments afférents à sa maladie.

Les compétences nécessaires pour dispenser l’éducation thérapeutique du patient sont déterminées par décret.

Dans le cadre des programmes ou actions définis à l’article L. 1161-3, tout contact direct entre un malade et son entourage et une entreprise se livrant à l’exploitation d’un médicament ou une personne responsable de la mise sur le marché d’un dispositif médical ou de son accessoire ou d’un dispositif médical de diagnostic in vitro ou de son accessoire est interdit.
