Article L121-1 of the French Insurance Code

Property insurance is an indemnity contract; the indemnity payable by the insurer to the insured may not exceed the value of the insured item at the time of the loss.

It may be stipulated that the insured must remain his or her own insurer for a specific sum or proportion, or that he or she must pay a deduction fixed in advance from the claim settlement.

L’assurance relative aux biens est un contrat d’indemnité ; l’indemnité due par l’assureur à l’assuré ne peut pas dépasser le montant de la valeur de la chose assurée au moment du sinistre.

Il peut être stipulé que l’assuré reste obligatoirement son propre assureur pour une somme, ou une quotité déterminée, ou qu’il supporte une déduction fixée d’avance sur l’indemnité du sinistre.
