Article L1211-3 of the French General Code of Local Authorities

The Local Finance Committee controls the distribution of the global operating grant.

It sets, where applicable, the amount of the lump-sum grant under the conditions provided for in articles L. 2334-7 and L. 2334-7-1 and determines the share of resources allocated to the endowments mentioned in articles L. 1211-5, L. 1613-5, L. 2334-13 and L. 3334-4 as well as the sums placed in reserve and the top-ups mentioned in article L. 3335-2.

The Government may consult it on any bill, any draft Government amendment or any regulatory provisions of a financial nature concerning local authorities. For decrees, this consultation is mandatory. When a decree of a financial nature concerning local authorities creates or modifies a mandatory standard, the consultation of the Local Finance Committee also covers the financial impact of the standard.

Each year, before 31 July, the accounts for the last known financial year of local authorities are submitted to it and to the Finance Committees of the National Assembly and the Senate.

Le comité des finances locales contrôle la répartition de la dotation globale de fonctionnement.

Il fixe, le cas échéant, le montant de la dotation forfaitaire dans les conditions prévues aux articles L. 2334-7 et L. 2334-7-1 et détermine la part des ressources affectées aux dotations mentionnées aux articles L. 1211-5, L. 1613-5, L. 2334-13 et L. 3334-4 ainsi que les sommes mises en réserve et les abondements mentionnés à l’article L. 3335-2.

Le Gouvernement peut le consulter sur tout projet de loi, tout projet d’amendement du Gouvernement ou sur toutes dispositions réglementaires à caractère financier concernant les collectivités locales. Pour les décrets, cette consultation est obligatoire. Lorsqu’un décret à caractère financier concernant les collectivités territoriales crée ou modifie une norme à caractère obligatoire, la consultation du comité des finances locales porte également sur l’impact financier de la norme.

Chaque année, avant le 31 juillet, les comptes du dernier exercice connu des collectivités locales lui sont présentés ainsi qu’aux commissions des finances de l’Assemblée nationale et du Sénat.
