Article L1221-1 of the French General Code of Local Authorities

A national training council for local elected representatives is created, chaired by a local elected representative. This council is made up of local elected representatives and qualified personalities. Its members carry out their duties in compliance with the ethical principles mentioned in article L. 1111-1-1. Its meetings may be organised in electronic form.

The council formulates opinions and recommendations relating to the training of local elected representatives in order to enhance its effectiveness, ensure its transparency and guarantee its financial equilibrium, under the conditions set out in this chapter. Taking into account the proposals of the Orientation Council referred to in article L. 1221-2, it draws up a directory of training courses related to the exercise of the mandate, which it forwards to the Minister responsible for local authorities. It issues a prior opinion on applications for the granting and withdrawal of approval for training bodies under the conditions laid down in article L. 1221-3. It issues opinions on the implementation of the individual right to training referred to in article L. 1621-3. The fund manager keeps it regularly informed of the fund’s financial situation and attends Board meetings in an advisory capacity. The Council gives its opinion on the proposals of the Orientation Council mentioned in article L. 1221-2. At the request of the Government, it may issue an opinion on any draft text relating to the training of local elected representatives.

Each year, the Council draws up an annual report on its work, outlining the main developments in the training of local elected representatives and formulating proposals falling within its remit. This report also includes an assessment of the management of the individual training entitlement of local elected representatives referred to in article L. 1621-3. It is forwarded to the Minister responsible for local authorities and made public.

The terms of application of this article are determined by decree in the Conseil d’Etat.

Article L1221-1

Il est créé un conseil national de la formation des élus locaux, présidé par un élu local. Ce conseil est composé d’élus locaux et de personnalités qualifiées. Ses membres exercent leur mission dans le respect des principes déontologiques mentionnés à l’article L. 1111-1-1. Ses réunions peuvent être organisées sous forme dématérialisée.

Le conseil formule des avis et recommandations relatifs à la formation des élus locaux afin d’en renforcer l’efficacité, d’en assurer la transparence et d’en garantir l’équilibre financier, dans les conditions prévues au présent chapitre. Il élabore, en tenant compte des propositions du conseil d’orientation mentionné à l’article L. 1221-2, un répertoire des formations liées à l’exercice du mandat qu’il transmet au ministre chargé des collectivités territoriales. Il formule un avis préalable sur les demandes de délivrance et les retraits d’agrément des organismes de formation dans les conditions prévues à l’article L. 1221-3. Il formule des avis sur la mise en œuvre du droit individuel à la formation mentionné à l’article L. 1621-3. Le gestionnaire du fonds l’informe régulièrement de la situation financière du fonds et participe aux réunions du conseil avec voix consultative. Le conseil se prononce sur les propositions du conseil d’orientation mentionné à l’article L. 1221-2. A la demande du Gouvernement, il peut formuler un avis sur tout projet de texte relatif à la formation des élus locaux.

Chaque année, le conseil établit un rapport annuel relatif à ses travaux, retraçant les principales évolutions de la formation des élus locaux et formulant des propositions relevant de ses attributions. Ce rapport comprend également le bilan de la gestion du droit individuel à la formation des élus locaux mentionné à l’article L. 1621-3. Il est transmis au ministre chargé des collectivités territoriales et rendu public.

Les modalités d’application du présent article sont déterminées par décret en Conseil d’Etat.
