Article L1222-13 of the French Labour Code

The period of secure voluntary mobility is set out in an amendment to the employment contract, which sets out the purpose, duration, effective date and term of the mobility period, as well as the period within which the employee must inform the employer in writing of his or her decision not to return to the company.

It also sets out the situations and procedures for the employee’s early return, which must take place within a reasonable period of time and which, in all cases, remains possible at any time with the employer’s agreement.

La période de mobilité volontaire sécurisée est prévue par un avenant au contrat de travail, qui détermine l’objet, la durée, la date de prise d’effet et le terme de la période de mobilité, ainsi que le délai dans lequel le salarié informe par écrit l’employeur de son choix éventuel de ne pas réintégrer l’entreprise.


Il prévoit également les situations et modalités d’un retour anticipé du salarié, qui intervient dans un délai raisonnable et qui reste dans tous les cas possible à tout moment avec l’accord de l’employeur.
