Article L1225-39 of the French Labour Code

The dismissal of an employee is cancelled if, within fifteen days of being notified of the dismissal, the person concerned sends his employer, under conditions determined by regulation, a certificate proving the arrival in his home, within fifteen days, of a child placed with a view to adoption. This certificate is issued by the administrative authority or by the authorised adoption body that placed the child.

These provisions do not apply if the employee is dismissed for serious misconduct unrelated to the adoption or because it is impossible to maintain the employment contract for a reason unrelated to the adoption.

Le licenciement d’un salarié est annulé lorsque, dans un délai de quinze jours à compter de sa notification, l’intéressé envoie à son employeur, dans des conditions déterminées par voie réglementaire, une attestation justifiant l’arrivée à son foyer, dans un délai de quinze jours, d’un enfant placé en vue de son adoption. Cette attestation est délivrée par l’autorité administrative ou par l’organisme autorisé pour l’adoption qui procède au placement.

Ces dispositions ne s’appliquent pas lorsque le licenciement est prononcé pour une faute grave non liée à l’adoption ou par impossibilité de maintenir le contrat de travail pour un motif étranger à l’adoption.
