Article L1226-21 of the French Labour Code

If the employee is not declared unfit at the end of the suspension periods, the termination of the fixed-term employment contract by the employer in breach of the provisions of article L. 1226-8 entitles the employee to compensation corresponding to the loss suffered. This compensation may not be less than the amount of salary and benefits that the employee would have received until the end of the current period of validity of his contract.

The same applies to an employee declared unfit in the event of termination by the employer in breach of the provisions of Articles L. 1226-10 and L. 1226-11 or the second paragraph of Article L. 1226-20.

Article L1226-21

Lorsque le salarié n’est pas déclaré inapte à l’issue des périodes de suspension, la rupture du contrat de travail à durée déterminée par l’employeur en méconnaissance des dispositions de l’article L. 1226-8 ouvre droit à une indemnité correspondant au préjudice subi. Cette indemnité ne peut être inférieure au montant des salaires et avantages qu’il aurait reçus jusqu’au terme de la période en cours de validité de son contrat.

Il en va de même pour un salarié déclaré inapte en cas de rupture par l’employeur en méconnaissance des dispositions des articles L. 1226-10 et L. 1226-11 ou du deuxième alinéa de l’article L. 1226-20.
